Potential for UK Visa for disabled relative? Rate Topic: -----

Hi

Does anyone have any idea on the constraints of getting a visa for a disabled relative to migrate to the UK?

My OH's mother has an old-Rhodesian passport and we understand she is entitled to UK citizenship - she is looking at the potential to move to the UK (she has some family there).
However she has an adult disabled dependent daughter who is a South African citizen.

I was just wondering if anyone had experience or knowledge of whether the dependent daughter might be granted or rejected a UK visa?

Hi Millie
I would double check the situation regarding your OH's mother. There was a big change to the law in about 1981, and in almost all cases now, you cannot obtain British Citizenship merely because you were Rhodesian, held a Rhodesian passport or were born in Rhodesia. That would pretty much put paid the the question regarding the disabled adult dependent daughter.

If your OH's mother can take up residency through a particular category, that is different to citizenship, and different rules apply.

In the case of the disabled adult daughter, I would suggest that once the status of the mother is clear, you would have to petition the UK govt on compassionate grounds. This can be expensive, time-consuming and frustrating, but is certainly possible.

I had phone the British Embassey in Pretoria a couple of times and they said there would be no problem at all with OH mother with her having a Rhodesian passport - but to be honest was not totally assured the person I spoke to knew (hence ringing twice). The Rhodesian passport was a "British" passport - I can see that I should look further into this - thanks.

I had thought that they would probably need to go the compasionate route as the disabled daughter has never worked so I could see some problems when I was looking through some of the options.
